By accessing “Planet Zot Forums” (hereinafter “we”, “us”, “our”, “Planet Zot Forums”, “http://www.planetzot.com/forums”), you agree to be legally bound by the following terms. If you do not agree to be legally bound by all of the following terms then please do not access and/or use “Planet Zot Forums”. We may change these at any time and we’ll do our utmost in informing you, though it would be prudent to review this regularly yourself as your continued usage of “Planet Zot Forums” after changes mean you agree to be legally bound by these terms as they are updated and/or amended.
1. ACCEPTANCE OF TERMS
This Terms of Service ("TOS") sets out the legally binding terms of your use of the Web site and the Service, and outlines the service agreement between Planet Zot (http://www.planetzot.com/) and you, the user. Its terms and conditions apply to all sites, services, and resources within Planet Zot. By using this site, you (and your parents, if you are under 18) agree to abide by the following terms and conditions. Planet Zot retains the permission to update the TOS at any time without any notice. You may review the most current version of the TOS at any time at: http://www.planetzot.com/forums/ucp.php?mode=terms. When using any Planet Zot services, you shall be subject to any posted guidelines or rules applicable to such services. You are expected as an user to abide by these rules as well as the code of user conduct outlined in the TOS. Failure to comply may lead to you being immediately and permanently banned, with notification of your Internet Service Provider if deemed required by us. The IP address of all posts are recorded to aid in enforcing these conditions.
2. DESCRIPTION OF SERVICE
The virtual world of Planet Zot contains, but is not limited to, forums for chatting and exchanging information with other users, an Oekaki board for creating art and receive feedback, a website which provides information about various cartoons and animations, a rating service which allows to rate animated cartoon characters, and an eCard service for sending virtual greeting cards to other people. While participating at the forums the users will be able to accumulate points called "Stardust", a virtual currency used on Planet Zot which may be used to purchase virtual goods to enchant the user's virtual cartoon representation of them selves on the forum called "Davvie". All of the features on Planet Zot are provided under the condition that the user understands and agrees that the service is provided "AS-IS" on a good-faith basis.
3. TERMS OF MEMBERSHIP AND SECURITY
Upon completing the registration process you will receive a member account identified by the user's chosen username and password. The user alone is responsible for maintaining the confidentiality of the password along with any information associated with the user's account that the user desire to remain confidential, and the user understands that he or she may be held responsible for any or all activities that occur through his or her PlanetZotian identity. Should the user's password become compromised, the user is alone responsible for immediately notifying Planet Zot. The user also agrees to restrain from creating multiple accounts, and will respect the requirement of "only one account per member and only one member per account". Planet Zot prohibits the transfer of control of any Planet Zot account by the registered account holder to any other individual or party, or to share an account with other individuals. Planet Zot will not be responsible or liable for any loss or damage incurred, or later arising from the user's failure to comply with this section.
4. CODE OF USER CONDUCT
The user is entirely responsible for the content he or she submit to Planet Zot, may it be textual, graphical or photographic, publically posted or privately transmitted. This includes but is not limited to posts, emails, private messages, graphics, drawings, links, arts, votes or photographs. While Planet Zot works actively to remove or edit any generally objectionable material as quickly as possible, it is impossible to review every submission, and can therefore not guarantee the accuracy, integrity or quality of any user submitted content. The views expressed therein are those of the posters and do not necessarily reflect those of Planet Zot, the owner, administrator, moderators, partners, advertisers or affiliates. Planet Zot assume no responsibility for the posts or the information contained therein, nor do they make any claims, promises or guarantees about the accuracy, suitability or completeness of any of the information in the posts.
By posting or submitting material on the Planet Zot, you grant Planet Zot a royalty-free, perpetual, irrevocable, non-exclusive right (including any moral rights) and license to use, reproduce, edit, modify, adapt, publish, translate, create derivative works from, distribute, communicate to the public, perform and display the submitted content (in whole or in part) worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed, for the full term of any rights that may exist in the content.
You agree that “Planet Zot Forums” have the right to remove, edit, move or close any topic at any time should we see fit. As a user you agree to any information you have entered to being stored in a database.
Under no circumstances will Planet Zot be liable in any way for any content - including but not limited to - errors, omissions in content; loss or damage of any kind incurred as a result of the use of any content posted, emailed, transmitted or otherwise made available on Planet Zot. Since Planet Zot do not operate with any age restrictments a significant portion of the community is of young age. All users are therefore required to keep the content of all their submissions to a PG-13 level. Any not child-friendly material and things of mature content may, within reason, be permitted on occasional basis if branded with visible warnings, or, if in the Oekaki board, screened with the mature content image.
As an user you agree not to submit or make in way available content that (a) is knowingly false, and/or defamatory, harmful, pornographic, threatening, illegal, hateful, abusive, harassing, profane, defamatory, vulgar, obscene, libelous, invasive of another's privacy, racist or otherwise objectionable, (b) promotes the harm of an individual, group, or institution, (c) contains any viruses, Trojan horses, worms, time bombs, cancelbots or other computer programming routines that are intended to damage, abuse, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information, (d) promotes piracy, and (e) violates any laws be it of your country, the country where “Planet Zot Forums” is hosted or International Law.
As an user you also agree to restrain from doing any of the following offences while on Planet Zot:
I. Flaming (purposely behaving offensively towards other members) and trolling (intentionally posting inflammatory statements to get people angry or upset), or otherwise act rudely and aggressively against other users.
II. Impersonation of any person or entity, or falsely state or otherwise misrepresent the affiliation with a person or entity.
III. Spamming, which included but is restricted to, making unnecessary posts with the only purpose of earning Stardust, single-word posts, post consisting only of smileys, repeatedly off-topic replies, distributing any sending unsolicited or unauthorized electronic junk mail, advertising, promotional materials, pyramid schemes, chain letters, or any other form of solicitation.
IV. Spoofing, characterized by the manipulation of identifiers in order to disguise the origin of any content transmitted through Planet Zot. V. Using any parts of Planet Zot to either advertise or promote commercial endeavors or any other websites, which includes direct posts, as well as, active links to other sites on the Internet, without permission from the Planet Zot Administrator.
VI. Incorporating any word in your name, Message ID or custom user title that is defamatory, obscene or profane, or which violates any trademark, service mark, or other proprietary/intellectual property rights of any third party, including, without limitation, that of Planet Zot.
VII. Interfere with or disrupt the service, servers or networks connected to the service, or disobey any requirements, procedures, policies and/or regulations of networks connected to the service.
5. NO RESALE OR REPRODUCTION OF SERVICE(S)
You agree not to reproduce, duplicate, copy, sell, trade, resell or exploit for any commercial purposes, any portion of Planet Zot including, but not limited to your davvie and your account on Planet Zot. You are not allowed to reproduce any portions of the Planet Zot website outside of the planetzot.com dominion without prior consent from the Administrator, including the davvies and davvie items.
6. TERMINATION
Planet Zot may terminate your account in whole or part, or remove or discard any parts of the content you may have submitted at any time, for any reason, with or without notice. Planet Zot reserves the right to terminate your access to the service at any time or deactivate and/or delete your account and part/all information, items and/or Stardust in your account at any time, with or without notice. Further, you agree that Planet Zot shall not be liable to you or any third party for any termination of your access to the service or any loss or deletion of your submitted content.
7. DISCLAIMER OF WARRANTIES
You expressly understand and agree that: 1. YOUR USE OF THE SERVICE IS AT YOUR OWN SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. PLANET ZOT EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, TITLE, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. PLANET ZOT ASSUMES NO RESPONSIBILITY FOR THE ACCIDENTAL OR CIRCUMSTANTIAL LOSS OF ITEMS, STARDUST, DAVVIE, LOST COMMUNICATIONS, MISSED EVENTS OR LOSS OF PERSONALIZATION OF A USER'S ACCOUNT FOR ANY REASON. 2. WITHOUT LIMITING THE FOREGOING, PLANET ZOT MAKES NO WARRANTY THAT (i) THE SERVICE WILL MEET YOUR REQUIREMENTS, (ii) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (iii) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE, (iv) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS, OR (v) ANY ERRORS IN THE SERVICE WILL BE CORRECTED. 3. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM PLANET ZOT OR THROUGH OR FROM THE SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS OF SERVICE. ANY MATERIAL DOWNLOADED OR EXPOSED TO THROUGH YOUR EXPERIENCE AT PLANET ZOT IS DONE AT THE USER'S RISK AND DISCRETION, PLANET ZOT IS NOT RESPONSIBLE FOR THE CONTENT OF ANY LINKS POSTED OR SUBMITTED BY ANY USER ON ANY PART OF THE WEBSITE.
8. LIMITATION OF LIABILITY
YOU EXPRESSLY UNDERSTAND AND AGREE THAT PLANET ZOT SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, SLEEP, MISSING SCHOOL/WORK, INTERNET BILLS OR ANY OTHER INTANGIBLE LOSSES, THAT PLANET ZOT CAN NOT FORESEE BUT MIGHT ARISE AS THE RESULT OF USING THE SERVICE, RESULTING FROM: (i) THE USE OR THE INABILITY TO USE THE SERVICE; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SERVICE; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iv) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE; (v) PLANET ZOT'S MODIFICATION OR TERMINATION OF THE SERVICE OR YOUR ACCOUNT, OR (vi) ANY OTHER MATTER RELATING TO THE SERVICE. ADDITIONALLY, YOU AGREE TO INDEMNIFY AND HOLD PLANET ZOT A SUBSIDIARY OF PLANET ZOT AND ITS STAFF, INCLUDING THE ADMINISTRATOR, HARMLESS FROM ANY CLAIM OR DEMAND MADE BY PLANET ZOT OR ANY THIRD PARTY DUE TO OR ARISING OUT OF CONTENT YOU SUBMIT, POST, TRANSMIT OR MAKE IN ANY WAY AVAILABLE THROUGH THE SERVICE, YOUR VIOLATION OF THE TOS, OR A VIOLATION OF ANY RIGHTS OF ANOTHER.
